The Administrative Court of Justice officially responded to the doubts raised in recent weeks regarding the uploading of the attorney’s license in the National System of Licenses and announced; The Bar Association must upload this license.
Uploading or not uploading the attorney’s license in the national system of licenses was a matter of dispute between the Ministry of Economy and the Bar Association, which brought the matter to the Administrative Court of Justice. Following the complaint of the Bar Association in opposition to the 2017 resolution of the Board of Deregulation and Facilitation of Issuance of Business Licenses stating that; The attorney’s license is uploaded to the country’s national license portal, the Administrative Court of Justice issued its decision and announced it; Since the attorney is not a business, the attorney’s license should not be uploaded in the mentioned portal.
This decision became the source of many years of opposition and resistance of the Bar Association to refuse to upload the lawyer’s license.
But this was not the whole story; After the publication of the decision of the Court in 2018, the Commission for Publication and Free Access to Information (in the Ministry of Culture and Islamic Guidance), of which the head of the Court of Administrative Justice is one of its members; It was approved that the bar association should upload the lawyer’s license in the country’s national license portal.
After the approval of this decree, a complaint was again filed in the Administrative Court of Justice, which this time gave a different verdict; Uploading the attorney’s license in the portal is according to the law.
Due to the existence of a possible conflict between the opinions of the general board in an issue, the head of the Court of Administrative Justice referred the decision to the specialized board of the court, which was stated in the response; There is no conflict.
This procedure continued until; In June last year, the deregulation board approved that the attorney’s license be uploaded to the business license system. The Bar Association again complained about this resolution and complained to the Court of Administrative Justice, which this time also annulled this resolution.
While the lawyers’ association was intoxicated with the victory over the Ministry of Economy, the existence of these contradictory situations prompted the Administrative Court of Justice to end this controversy by declaring its clear position. The court’s position in this regard is clear: “Bar associations must upload their licenses to the national license portal.”
In the explanation of the Court of Administrative Justice, which was broadcast by the Director General of its presiding area and was officially broadcast by the news section of the Islamic Republic of Iran Television, it has been announced: “Bar associations are required to upload their attorney’s license in the country’s national license portal (business license system) Although the court annulled the decision of the deregulation board with its recent decision, but if this is required by other laws, the decision of the court does not violate those laws.”
In this way, the few excuses of the Association of District Attorneys for not uploading the attorney’s license in the National System of Licenses have lost color and this association should not object to the uploading of the license.
